Practice Focus

Dominic is a partner in Tressler’s New York office. He concentrates his practice in the representation of primary, excess and surplus lines insurers in complex insurance coverage disputes arising under various forms of commercial general liability, directors and officers liability, professional liability, employers liability and errors and omissions insurance policies.

Dominic has nearly 30 years of experience acting as coverage and litigation counsel in complex insurance coverage disputes arising from construction defects, products liability, cyber and data breach, transportation, personal and advertising injury, pollution and environmental, malicious prosecution, discrimination and employment, errors and omissions and various other casualty and property damage claims under primary, excess and umbrella insurance policies as well rescission and bad-faith actions and risk transfer analysis and litigation. He has successfully litigated declaratory judgment actions in state and federal courts throughout the United States and has participated in numerous alternative dispute resolution proceedings, including mediations and arbitrations before the AAA, JAMS and NAM.

Professional Background

Prior to joining Tressler as a partner in its insurance litigation group, Dominic was a partner, of counsel and/or senior associate in the insurance litigation departments of several national insurance law firms.

Representative Experience

-Obtained favorable settlement in an insurance coverage action in New York involving a buy-back of Commercial General Liability insurance policies because of alleged misrepresentations by insured in underwriting submissions. 

-Obtained summary judgment in a declaratory judgement action in New York involving misrepresentations allegedly made by insurance broker in connection with the procurement of workers’ compensation insurance. 

-Obtained favorable settlement in an insurance coverage action in New York involving rescission of primary and excess policies based upon alleged misrepresentations by insured in underwriting submissions. 

-Obtained favorable settlement in $20 million insurance coverage and construction defects litigation in New Jersey involving a large residential condominium development and numerous primary and excess insurers. 

-Obtained summary judgment in $200 million complex insurance coverage litigation in Delaware arising from an underlying multi-district products liability class-action involving a leading window and door manufacturer. 

-Obtained favorable settlement in $100 million insurance coverage litigation in Connecticut arising from an electric power generation plant construction site explosion involving numerous OCIP and non-OCIP insurers. 

-Represented excess insurer in $50 million complex insurance coverage litigation in New York arising from a data breach involving a large multinational entertainment and consumer electronics company. 

-Obtained favorable settlement in $20 million insurance coverage litigation in Maryland arising from malicious prosecution of multiple lawsuits against an entertainment company for alleged animal cruelty. 

-Obtained favorable settlement in AAA mediation in Louisiana in $25 million complex insurance coverage and construction defects claim involving a large university and several well-known architectural design firms. 

-Obtained favorable settlement in $50 million insurance coverage litigation in New York arising from a construction site accident at a Wall Street investment bank involving numerous OCIP and non-OCIP insurers. 

-Obtained favorable settlement in an insurance coverage litigation in New York arising from $30 million construction defects claim involving a large university and a large power generation corporation.

-Obtained favorable settlement in an insurance coverage litigation in New York arising from fraudulent misrepresentations made by an insured under a primary general liability policy.

-Obtained favorable settlement in JAMS mediation in California in $200 million legal malpractice claim against a major law firm arising from a cable television industry merger and acquisition transaction. 

-Represented excess insurer in insurance coverage litigation in New York arising from claims against a video game technology company alleging options backdating and other fraudulent accounting practices. 

-Represented primary insurer in $10 million insurance coverage litigation in Pennsylvania arising from breach of contract and fiduciary duty claims against a travel industry company and its directors and officers. 

-Obtained summary judgment in complex insurance coverage litigation arising from a high-profile $1 billion antitrust suit in Texas against several leading railroad transportation companies.

-Obtained summary judgment in $200 million complex insurance coverage litigation in Connecticut involving a leading air-conditioning manufacturer seeking insurance coverage for environmental liabilities. 

-Represented a leading data mining company in a multi-district class action arising from the alleged release by a leading low-cost airline carrier of private passenger information to the data mining company.
