James Borcia is a partner in the firm's Chicago office. He serves as an active trial attorney and works in the Commercial Litigation Group with an emphasis on bankruptcy, intellectual property and professional liability matters. He has extensive experience representing creditors and third parties in bankruptcy proceedings, primarily representing companies and insurers.
Jim is primarily involved with counseling companies and insurers when their customers, insureds and third parties, co-defendants and plaintiffs file bankruptcy. These services include filing and litigating proofs of claim, lifting the automatic stay in order to allow litigation to proceed outside of the bankruptcy, having the bankruptcy court approve settlement agreements and defending numerous preference and fraudulent conveyance actions.
Jim has represented companies in patent, trademark, copyright and trade secret litigation. He has served as trial counsel in numerous high profile intellectual property cases, including the Planet Hollywood v. Hollywood Casino trademark and trade dress case. He also served as trial counsel for the lead defendant in the landmark Marobie v. NAFED copyright litigation.
Jim is also the author of the Commercial Litigation column in the IDC Quarterly. He was selected as a 2019 Illinois Leading Lawyer.
