Trucking & Transportation Litigation
The Tressler Trucking & Transportation Practice Group is comprised of a team of skilled and experienced attorneys who serve as corporate counsel for trucking companies, motor carrier insurers, risk managers, shippers and freight intermediaries across the country. Our practice group is designed to provide operationally-based and comprehensive services which address the day-to-day challenges facing our clients.
Practice group members are problem solvers, risk managers, and advocates. They are experienced in personnel management; mergers and acquisitions; contract review and negotiation; environmental and real estate due diligence; reorganization; litigation oversight; pursuit and defense of cargo claims; insurance coverage questions; and accident response efforts. In addition, members can offer guidance in Compliance, Safety, Accountability (CSA) compliance and risk exposure. CSA is a Federal Motor Carrier Safety Administration (under the U.S. Department of Transportation) initiative to improve large truck and bus safety and ultimately reduce crashes, injuries, and fatalities that are related to commercial motor vehicles.
Practice group members have advised clients on the hiring and retention risks created by CSA; assisted carriers on operating authority documents and safety initiatives; counseled freight brokers on vicarious liability; negotiated more advantageous shipping contracts and equipment leases; and offered advice with respect to creating effective claims investigation and reduction protocols. Tressler is also experienced in insurance coverage, self-insured and retention programs, and captive insurance companies as tools for risk and financial management efforts.
The Trucking & Transportation Practice Group also monitors changes in industry regulations and case law relating to hours of service requirements, driver and equipment compliance, hazardous material handling, HIPAA standards, OSHA and EEOC matters.
With Tressler uniquely positioned “At the Intersection of Trucking & Law,” the firm’s Trucking & Transportation Practice Group is truly corporate counsel for trucking companies. When carriers find themselves confronting the complex cross currents of trucking law, Tressler provides sound direction.
