Tressler’s multifaceted Construction and Real Estate practice group represents builders, developers, property owners, general contracting firms, insurance companies, sureties, banks and mortgage lenders in an array of construction and real estate matters.We represent owners and developers in the acquisition, development, financing, construction and disposition of commercial, retail, industrial, office and residential projects. We have advised clients with respect to single- and multi-family developments, condominium developments and conversions, mixed-use projects, apartment buildings and shopping centers.
We assist in the structure and formation of ownership entities, whether joint ventures, limited partnerships, limited liability companies or other types of entities, as well as with corporate, securities, finance and tax matters related to real estate ownership, development and transfers of ownership. In addition, we represent real estate and construction clients in municipal annexation and subdivision proceedings, as well as with eminent domain, zoning and land use, and entitlements. We also provide title insurance services.
Tressler’s Construction and Real Estate practice includes highly experienced attorneys who handle the legal aspects of environmental due diligence, assessments and remediation, securing environmental land owner defenses under federal and state law. We also advise owners, developers and contractors on incorporating green construction techniques into construction and renovation projects.
Upon a project’s completion, our attorneys are skilled advisors to ownership in the leasing, operation and sale of these properties.
Our team’s extensive experience also includes representing owners, developers and contractors in design and construction matters; surety performance, payment and subdivision bonds; landlord- tenant matters; and real estate workouts. We have extensive experience in construction and real estate related litigation, from bond claims, contract disputes and loan work-outs, to personal injury, property damage and environmental claims.
Tressler’s Construction and Real Estate practice group excels in public and private construction project default analysis, negotiation of financing and takeover agreements, and performance and payment bond claim handling and litigation. We prosecute and defend all types of contract, lien, bond, tort and insurance claims for and against owners, developers, architects, engineers, contractors, subcontractors and suppliers. We efficiently resolve bid disputes; extra work and change order claims; completion issues; construction lending issues and disputes; contract compliance issues; quality of work, design defect, delay, interference and acceleration issues; differing site condition claims; mechanics liens; liens against public funds; and insurance coverage claims. We are proficient and experienced in indemnity and salvage, priority
disputes and bankruptcy relief.
In construction defect matters, our team counsels insurance clients and owner, developer and contractor clients in construction defect and property damage claims. We also advise clients with regard to indemnity and additional insured analysis, as well as personal injury claims.
In addition to representing owners, developers and contractors, Tressler’s Real Estate and Construction group represents lead and mezzanine lenders in residential, commercial and industrial real estate acquisition, development, construction and permanent financing transactions. We have extensive experience representing these clients in restructuring and workouts of troubled loans, deeds in lieu, consent foreclosures and other debtor/creditor enforcement actions.
