About the Event
The panel will discuss the challenges to insurers and insureds posed by insurance policies in which defense costs erode the limits of coverage, including the potential for bad faith exposure to the insurer if the insured is required to contribute to a settlement or verdict due to the erosion of the policy limits due to by defense costs, the particular challenges when multiple insureds (including additional insureds) with separate counsel seek defense under eroding limits policies, strategies for insurers and insureds involved in defending cases with an eroding limits policy and the impact of excess insurance in these situations.
