About the Session
Many construction site and commercial accidents trigger disputes among multiple parties and insurers; often, the injured plaintiff fails to name all pertinent parties in a lawsuit and the issue of whether additional insured coverage applies—from a policy purchased by one who was not named in the suit—is frequently debated. We’ll explore recent rulings from jurisdictions which limit such coverage to claims of vicarious liability (claims flowing from fault of the named insured), comparing them to other jurisdictions which reject strict limits and instead impose broader causation-related limits to give participants a full understanding of the different legal approaches taken in evaluating additional insured coverage. We’ll also examine issues arising from other risk-shifting methods such as indemnity agreements.
