Erin L. Peters to Speak as a Panelist at the NJDA/ICNJ Auto Liability Seminar

Tressler attorney Erin L. Peters will be speaking at a seminar called “New Jersey Defense Association (NJDA)/Insurance Council of New Jersey (ICNJ) Auto Liability Seminar” on Tuesday, November 26th at APA Hotel Woodbridge in New Jersey. She is set to present as part of a three-attorney panel on a segment titled “Auto Liability Case Law Update.” The presentation is focused on the admissibility of expert testimony in the state of New Jersey, and how the standard for determining “reliability” has evolved in the last 100 years. The admissibility of expert testimony is relevant across many areas of practice. Erin will discuss the “general acceptance” test established by the Supreme Court of the United States in Frye v. United States, and how the federal laws evolved with the 1975 creation of Federal Rules of Evidence 702 and its 2000 and 2023 amendments, and the 1993 Supreme Court decision in Daubert v. Merrell Down Pharmaceuticals.

Additionally, Erin will talk about how the New Jersey Supreme Court has shifted away from the “general acceptance” test and has placed increasing importance on the factors for reliability established by the Daubert Court. Most recently, in the 2023 decision of Seger v. Consolidated Rail Corporation, the New Jersey Supreme Court showed great deference to the Daubert factors and it seems that New Jersey is well on its way to become a “Daubert” jurisdiction. This is an important development for the defense bar, as the federal standard for admission of expert testimony is stringent, and full adoption of Daubert could lead to favorable decisions excluding expert testimony unless it meets the carefully defined factors.
