Previously, the 9th Circuit affirmed a lower court’s dismissal of a negligence suit lodged by insurer North of England P&I Club against client, Tesoro Refining and Marketing, alleging the company didn’t properly contain and clean up an oil spill in the Port of Long Beach in 2011.
