Meet Our 2025 Illinois Super Lawyers

Mark T. Banovetz
Partner



Mark concentrates his practice in the areas of aviation, insurance coverage and general civil and commercial litigation, including construction, professional liability, tort litigation and appellate work. Mark's clients benefit from his passion for aviation. He recently completed his FAA certification as a Commercial Pilot. Mark leads Tressler’s Aviation Practice Group and has been an instrument-rated private pilot for more than 22 years. 

Daniel J. Cunningham
Partner



Dan’s practice involves insurance coverage and bad faith litigation stemming from all sorts of underlying claims, including claims arising out of bodily injury, property damage, consumer protection statutes, privacy violations, defamation, intellectual property infringement, defective products and pollution. Dan has represented insurers in all aspects of litigation throughout the country. Additionally, Dan counsels insurers with regard to claim handling and underwriting issues.

Daniel R. Formeller
Chairman and Partner



Dan is Chairman of the firm. As a trial lawyer based in the firm’s Chicago office, Dan focuses his practice on business litigation and the resolution of business disputes through mediation and arbitration. Dan handles a wide variety of complex business litigation and counseling, including intellectual property, state and federal securities actions, anti-trust, ERISA, class actions and directors and officers liability matters. He has been lead trial counsel in bench and jury trials in state and federal courts throughout the United States. 

Charles A. LeMoine
Partner



Chuck is a partner who provides client services in both Tressler’s Government and Litigation Practice Groups. He has a wide range of experience in representing school districts and other public entities in all aspects of federal and state litigation, arbitration, and other forms of dispute resolution. These include FOIA, OMA, breach of contract, civil rights, sexual abuse, premises liability, vehicular liability, construction-related claims and insurance, employee benefits and worker’s compensation to name just a few.

Donald G. Machalinski

Don is Co-Chair of Tressler’s Aviation and Transportation Practice Group. Don concentrates his practice in aviation, product, professional and premises liability litigation and his practice also includes insurance coverage litigation. Don has an active casualty trial practice as well as an appellate practice for both liability and coverage matters.

William K. McVisk
Partner



Bill focuses his practice on complex insurance coverage litigation and hospital law and medical liability. He has handled all areas of coverage and bad faith litigation, especially third-party bad faith and coverage litigation involving commercial general liability, professional liability coverages as well as personal lines coverages such as auto and homeowners coverages.

John M. O'Driscoll
Partner



John is a partner and Co-Chair of Tressler's Government Practice Group. His practice includes representing companies and individuals in business disagreements and providing general counsel services to local governmental bodies such as municipalities, school districts, library districts and park districts. John handles a wide variety of disputes such as business litigation, breaches of contract, construction issues, employment disputes, property damage, tort liability defense, labor negotiations, internet defamation, ordinance violations, “sunshine laws” compliance, professional negligence matters and complex litigation.

Darcy L. Proctor
Partner



Darcy is a partner in Tressler’s Local Government Practice Group. Darcy concentrates her practice in the defense of local governments in all aspects of tort, civil rights liability and employment litigation. She also defends private sector employers across a variety of employment law issues. As a seasoned litigator, Darcy has taken dozens of cases to trial in both state and federal court.

Todd S. Schenk
Partner



Todd is a member of the firm's three-person Executive Committee and partner in Tressler's Insurance Services Practice Group. He is highly experienced in providing insurance coverage counseling and litigation representation to insurance companies. He is particularly skilled in handling third party claims involving advertising injury and product liability, and first party claims under residential and commercial property policies. Many of his cases require the defense of common law and statutory bad faith claims, which Todd litigates in venues around the country. He has also handled appeals in both state and federal courts around the country.

Rosa M. Tumialán
Partner



Rosa is a partner and Co-Chair of Tressler’s Insurance Services Practice Group, Chair of the Appellate Team and a member of the firm's national Diversity, Equity and Inclusion Committee. Rosa focuses her practice on insurance coverage and litigation. She is an accomplished defense attorney with more than twenty years of experience. Rosa’s insurer-related services include coverage opinion analysis and representing insurers in complex coverage disputes relating to personal and commercial lines, third party claims, surplus lines as well as claims handling practices and extracontractual liability. She has also litigated environmental coverage disputes throughout the Midwest for various insurers relating to superfund sites. Rosa assists with drafting coverage documents for insurance pools and counsels clients in the administration of same. Her practice also includes serving as national coordinating coverage counsel for insurance clients who rely on her to develop and implement strategies nationwide in response to pattern litigation. Rosa is an accomplished class action defense lawyer and appellate practitioner, having appeared and argued in both state and federal courts nationwide.

Sarah Hertz Maisel
Partner

Sarah is a partner and Co-Chair of the Insurance Services Practice Group at Tressler. She focuses her practice on a wide range of insurance coverage analyses and litigation. Sarah represents insurance companies in complex coverage litigation pending throughout the country in both state and federal courts. These actions involve various coverage lines, including commercial general liability, professional liability, management liability, excess exposures and extracontractual liability. She also has significant experience in defending underlying claims including handling matters through mediation, arbitration and trial.

Taylor A. Brewer
Associate



Taylor is an associate in Tressler's Litigation and Appellate Practice Groups. Taylor’s practice focuses on providing comprehensive services to the insurance industry including coverage analysis, pre-suit claims assessment and handling, insurance defense litigation, and appeals. His experience also extends to healthcare statutory and regulatory compliance, as well as advising and handling claims for state and local governmental entities.

Caitlin Frenzer
Associate



Caitlin is an associate and litigator in Tressler's Professional Liability Practice Group. Caitlin focuses her practice on the representation of professionals and insurance companies in complex civil litigation, including business, professional and management liability litigation, insurance coverage litigation and disputes, and other tort and contract actions.

Simone E. Haugen
Associate



Simone is an associate in Tressler's Professional Liability Practice Group. Simone focuses her practice on complex civil litigation matters, including professional and management liability litigation and other tort matters. Prior to joining Tressler, Simone was an associate at an insurance coverage firm where she represented insurance carriers and insureds in an array of insurance coverage matters.

About Illinois Super Lawyers and Rising Stars

Super Lawyers is a rating service of outstanding lawyers from more than 70 practice areas who have attained a high-degree of peer recognition and professional achievement. The patented selection process includes independent research, peer nominations and peer evaluations. Five percent of the total lawyers in the state are selected for inclusion in Super Lawyers.

The selection process for the Rising Stars list is the same as the Super Lawyers selection process, with one exception: to be eligible for inclusion in Rising Stars, a candidate must be either 40 years old or younger or in practice for 10 years or less. All attorneys first go through the Super Lawyers selection process. Those who are not selected to the Super Lawyers list, but who meet either one of the Rising Stars eligibility requirements, go through the Rising Stars selection process. While up to five percent of the lawyers in the state are named to Super Lawyers, no more than 2.5 percent are named to the Rising Stars list.
